Limited inspection conducted to assess the facility’s capacity and ability to abide by the City’s Public Health Order to cancel gatherings of 50 or more individuals. The facility was making all attempts to abide by the order and separated the exhibit into sections to limit the amount of people gathering. The facility is abiding by the Public Health Order to not allow dining in the facility. The facility’s design, staffing, business model, and need for queues outside and inside the facility, was discussed thoroughly and it was determined by the City, that while the facility was making every attempt to abide by the order, the operation at the aquarium exceeds the gatherings of 50 people as well as the required social distancing required to help prevent the spread of Covid 19. ***The facility is hereby ordered to cease and desist allowance of the public to queue, gather, or visit on-site in accordance with the City’s Public Health Order. Staff may be allowed in the facility to perform required daily tasks specific to the livelihood of animals in the care of the facility as well as maintaining the property. The number of staff must be kept below the required threshold of 50 and provided with enough space to allow social distancing of 6ft or more. The facility cannot reopen and resume normal operation until allowed by a representative of DDPHE or an official mandate from the Mayor’s Office. Failure to comply with this order may result in further enforcement action.*** Report emailed to operator.
