Apply for a transfer of location marijuana testing or R&D facility

Marijuana businesses must submit a marijuana license change of location application, complete hearing and inspection requirements, and get state approval before changing location. A public needs and desires hearing is required only for marijuana stores, marijuana hospitality businesses, and retail marijuana hospitality and sales businesses that apply to change location.

Submit a marijuana license change of location application

Step 1.Zoning use permit

This license requires a zoning use permit.

A zoning use permit grants the applicant/owner of a lot, building, or structure permission for the requested use of the land. "Use" can be any activity, occupation, business, or operation in a building or on a lot/tract of land.

If you currently do not have a zone use permit, you may apply instead with a Acknowledgement of Zone Use Permit(PDF, 87KB). This will allow you to begin your application while you secure a proper zone use permit. Your license will not issue until a proper zone use permit has submitted. Applications that fail to provide a zone use permit will not issue or be eligible for a refund.

  1. Before contacting Zoning, email CPD Records to ask if there's an existing zoning use permit for your address. Allow up to 10 business days for them to respond.
  2. If they respond there isn't a zoning use permit for your address, then contact Zoning to apply for a permit. They will tell you if you're zoned for the use. Allow up to 10 business days for them to respond.

Step 2.Complete an application

Complete a marijuana license change of location application(PDF, 258KB). Applications must be complete and include all required documents (see the required forms section below). Legal documents must be properly signed and executed. All materials must be legible. Incomplete applications will be rejected.

Step 3.Submit the application

Submit the complete application with all required documents. You can make an appointment with the cannabis process navigator by emailing Marijuanainfo@denvergov.org. Or you can submit an application by email to EXLApplications@denvergov.org.

Step 4.Pay the required fees

A city licensing technician will provide an invoice during or after application intake. Pay the required fee. (Information about fees are in the required fees section below the step-by-step guide.) Make checks payable to the "Manager of Finance." You can also pay in cash, or with a Visa, Discover or Mastercard.

You can pay online. Payments and Cashiering is also open for in-person payments. It is available Tuesday through Thursday, 8 a.m. to 4 p.m. Hours and days of operation are subject to change without notice.

Step 5.City application review

A city licensing technician will review the application and all required documents. This review could take 30 business days. It could take longer depending on the volume of applications pending before the Department.

Step 6.Public needs and desires hearing (not required for all license types)

Marijuana stores, marijuana hospitality businesses, and retail marijuana hospitality and sales businesses that apply to change location must complete a public needs and desires hearing. It could take an extra 30 to 60 business days after the city application review for a public hearing to be scheduled and to occur. A licensing technician will notify the applicant of the date of the hearing and provide relevant hearing materials. A hearing officer will make a recommended decision after the hearing occurs.

Step 7.Complete inspections and get state approval

When the licensing technician's review is complete and if a required needs and desires hearing results in a recommended approval of the change of location, they will provide an inspection notice. For more information, refer to the inspection process information below. The state Marijuana Enforcement Division will also receive a copy of your inspection notice. This notifies the state agency that you have applied for a change of location and it has been conditionally approved by the Department (pending completion of inspections). The applicant is responsible for completing a state report of changes application for the change of location. The Department requires proof of state approval.

Step 8.Email Excise and Licenses

After you complete the required city inspections, email EXLApplications@denvergov.org with:

  • The amendment record ID(s) for the change of location.
  • Proof of state approval for the change of location.
  • A request to close the amendment record ID(s) for the change of location.

Step 9.We'll update the record

A licensing technician will update your record with the new location information and note it has been completed. A licensing technician will also issue a new city license (if there are no other pending amendment records).

All applications will be administratively closed if they are not completed within 12 months.

 

Applications must be complete and include all required documents. Legal documents must be properly signed and executed. All materials must be legible. Incomplete applications will be rejected.

  • A complete possession of property certificate(PDF, 262KB); or
  • A deed; or
  • A complete, unredacted lease, including all lease amendments. If leased, the owner must provide written consent to lease the property to a marijuana facility. The lease must be valid for at least 90 days from the date a complete application is submitted.
  • A complete (PDF, 40KB)social impact plan form(PDF, 40KB) for every license (every license type, medical and retail).
  • A floor plan of the proposed premises (required for all license types except transporters with no licensed premises).

Floor plan requirements

Provide a floor plan, or several floor plans, drawn to scale on an 8½-inch-by-11-inch piece of paper. It is recommended you submit digitally designed floor plans or plans prepared by a design professional. Separate floors must be shown on separate pieces of paper and clearly identified. For example, basement, first floor, mezzanine, etc. The floor plan must be complete and accurate. The submission must include:

  • The physical layout of the establishment with the legibly labeled principal uses of each room in the premises.
  • The legible identification of all security cameras and DVR locations.
  • The intended licensed premises must be contiguous and outlined in red.
  • The intended limited access areas must be contiguous and outlined in green.
  • Stores only: Each room that is in the restricted access area must be labeled and must identify point-of-sale and sales counter locations.
  • If you submit several floor plans to meet all requirements outlined above, the physical layout and room uses must be identical for each floor plan showing the same section of the premises.

Definitions

  • Licensed premises: The premises in possession of the licensee and within which the licensee is authorized to cultivate, manufacture, distribute, sell, store, transport, or test marijuana.
  • Limited access area: The contiguous area within the licensed premises where marijuana is grown, cultivated, stored, weighed, packaged, or processed.
  • Restricted access area: The area within the licensed premises where marijuana is sold, possessed for sale, or displayed for sale.

During or after application intake, you will receive an invoice for $1,500 per store, marijuana hospitality or retail marijuana hospitality and sales license affected by the change of location. Or $1,000 per license for all other license types affected by the marijuana license change of ownership application.

Inspection process and information

When a licensing technician's review of your change of location application is complete, they will provide you with an inspection notice to complete the required inspections. It's recommended you engage professionals to ensure you're in compliance with building, zoning, public health and fire prevention requirements. Inspecting agencies will digitally pass or fail your inspections. All inspecting agencies must pass your inspections before the Department can close your change of location records.

Public Health and Environmental Quality inspect only certain license types. Otherwise, the following inspections are required for most change of location applications:
