The following document contains the Denver Public Trustee fee schedule effective as of January 1st, 2010.

NOTES

 

To be applied to fees and expenses (C.R.S. §38-38-107(2)). A foreclosure is deemed opened when the Notice of Election and Demand is recorded (C.R.S. §38‑38‑101(3)), and the Opening and Administering a Foreclosure fee is collectable at that time. (The Notice of Election and Demand processing and recording fees are included in this fee.)

 

 

 

FORM OF PAYMENTS TO THE PUBLIC TRUSTEE


Our office can accept only cash or checks. Foreclosure payments (cure or redeem) may not be made with personal checks. Certified funds must contain the word "Official" or "Cashier's" on the check. Credit cards and money orders are not acceptable at any time.
 

C.R.S. 38-37-108. All moneys payable to a public trustee at any foreclosure sale under the provisions of this article or upon redemption or cure under the provisions article 38 of this title shall be in the form of cash or by electronic transfer to an account of the public trustee available for such purpose or in the form of a certified check, cashier’s check, or teller’s check, or a draft denominated as an official check that is a teller’s check or a cashier’s check as those terms are defined in and governed by the "Uniform Commercial Code", title 4, C.R.S., made payable to such public trustee, certified or issued by a federally-chartered or state-charted financial institution, as defined in section 15-15–201(4), C.R.S., licensed to do business in the State of Colorado.

1.      All wires must go Fedwire. NO bank internal wire transfers allowed.

 

2.      Please reference the Public Trustee File Number number on all wire transfers and include any other helpful information, such as the attorney’s file number, the borrower’s name, the property address, and the transaction type (Cure, Redemption or Sale).

 

3.      Notify the Public Trustee’s Office of the payment immediately upon confirmation by calling 311.

 

NOTE: When pre-registering to bid at a foreclosure sale and sending funds by wire transfer, please give instructions in your wire that the monies are for a bid on a foreclosure. Or, please call 311 to inform the Public Trustee that you are wiring monies for a bid.

 

Any wire of funds for bidding on a foreclosure sale must be completed the day before the sale. Refer to the Foreclosure Sales Bids publication or the Bid Book in our office for the foreclosing lender’s bid, which your bid must exceed by at least $1.00.
