Civil Penalties
Civil Penalties are fines levied against regulated businesses which repetitively violate the City and County of Denver Retail Food Establishment Regulations and ordinances. Record of the Civil Penalties are present on the electronic record in the on-line Denver Restaurant Inspection Reports.

  

The new schedule for assessing civil penalties was implemented January 1, 2011.The fine schedule is based on a 12 month history, and fines will only be assessed for repeat violations of the same type, not including imminent health risks.

As of November 5, 2010, Notices of Enforcement are only posted for imminent health risks due to the operator’s negligence.

Town Hall Meeting Regarding Denver Restaurant and Food Establishment Civil Penalty Schedule and Compliance Policies
The Public Health Inspection Division is teaming with the Colorado Restaurant Association (CRA) to put on a Town Hall meeting open to CRA and non-CRA members alike on Tuesday, March 20th, 2012 from 9:00AM-11:00AM at 430 E 7th Ave, Denver (CRA offices).  The purpose of the meeting is to provide clarification and obtain feedback from the regulated community regarding the new compliance policies and civil penalty schedule that were implemented at the start of 2011.  Education and compliance resources available to the regulated community from the Public Health Inspection Division will also be discussed.

Enforcement Actions
In addition to Civil Penalties, the division imposes the following types of enforcement actions:

 

Closure for imminent health hazard: A directive is given to cease and desist using unsafe portions of the facility or the entire facility to ensure public health.

Grounds for closure due to imminent public health risks may include but are not limited to:

  No hot water
Sewage problems
No utilities
Fire
Pest infestation
Contaminated food
Food-borne illness outbreak
Extreme uncleanliness
Inadequate refrigeration



 
Closure for Cleaning: Restaurant is closed until a reinspection is made to assure that maintenance or repairs have been made.

 

Summons: An order to appear in court for alleged violations of failure to comply with applicable laws .
