Requirements for New and Existing Contractor Licenses and Certificates
Effective January 1, 2007
During a special session of the Colorado Legislature held in July 2006, state legislation was passed that prohibits illegal immigrants from obtaining city-issued licenses and certificates. As result of this legislation, individuals or sole proprietorships that are applicants for city-issued licenses and certificates must now adhere to amended procedures when seeking to obtain a new license or certificate or when attempting to renew an existing license or certificate. The following is information that specific prospective license and certificate applicants and specific existing license or certificate holders need to be aware of.

PERTINENT PROVISIONS OF THE LAWS:
COLORADO REVISED STATUTE, SECTION 24-34-107
· Every application by an individual or by a sole proprietor for a new Denver Contractor License or Certificate issued by Contractor Licensing or to renew an existing Denver Contractor License or Certificate shall require the applicant’s name, address, and social security number;
· Upon obtaining a new Denver Contractor License or Certificate or renewing an existing Denver Contractor License or Certificate, every applicant that is an individual or a sole proprietorship must provide an Affidavit of Lawful Presence and proof that he/she/it is lawfully present in the United States;
· Upon obtaining a new Denver Contractor License or Certificate or renewing an existing Denver Contractor License or Certificate, every applicant that is an individual or sole proprietorship must present a secure and verifiable identification as defined by Colorado law.
WHAT QUALIFIES AS A SECURE AND VERIFIABLE IDENTIFICATION FOR CITY-ISSUED CONTRACTOR LICENSES OR CERTIFICATES?
THE ORIGINAL OR A NOTARIZED COPY OF:
Any current Colorado Driver License, current Colorado Driver Permit or current Colorado Identification Card, expired one year or less. (Temporary paper license with invalid Colorado Driver’s License, Colorado Drivers Permit, or Colorado Identification Card, expired one year or less is acceptable).
· Out-of-state issued photo driver’s license or photo identification card, photo driver’s permit expired one year or less.
· U.S. Passport expired less than 10 years.
· Valid foreign passport with 1-94 or valid processed for 1551 stamps.
· Valid 1551 Resident Alien/Permanent Resident card. No border crosser or USA B1/B2 Visa/BCC cards.
· Valid 1688 Temporary Resident, I688B, and 1766 Employment Authorization Card with intact photo.
· Valid US Military ID (active duty, dependent, retired, reserve and National Guard).
· Tribal Identification Card with intact photo. (U.S. or Canadian).
· Certificate of Naturalization with intact photo.
COPIES THAT ARE NOT NOTARIZED WILL NOT BE ACCEPTED!!
Note: You may elect to mail in your certificate application, license renewal or certificate renewal with accompanying fees and necessary documents or personally visit the agency to apply for or renew your license or certificate. Mailed renewals and certificate applications must have both the affidavit notarized and the copy of a secure and verifiable identification notarized. In-Person applications or renewals with original secure and verifiable identification who sign the affidavit in-person do not need to supply notarized copies. Mail-in requirements apply to anyone bringing in documentation who is not the applicant, license holder, or certificate holder.
WHERE CAN APPLICANTS OBTAIN AN AFFIDAVIT OF LAWFUL PRESENCE or A DR 4679 – AFFIDAVIT – RESTRICTIONS on PUBLIC BENEFITS?
· An Affidavit of Lawful Presence or an DR 4679 – Affidavit – Restrictions on Public Benefits may be obtained at Contractor Licensing located in the Wellington E. Webb Municipal Office Building, 201 W. Colfax Avenue, Dept. 205 (2nd Floor), Denver, Colorado 80202;
· Each respective affidavit may additionally be obtained on this site:
· FORMS WILL NOT BE FAXED.
· Applicants must meet all other application or renewal requirements;
· Provisions of the law do not apply to Corporations, Partnerships, or LLC’s.
