is located on the 2nd floor in the Wellington E. Webb Municipal
Office Building which is located
of the corner of 14th and Bannock
Streets. The office is just north
of the City and County Building
and north of Civic Center Park
at Colfax Avenue. Office hours are:

PROCEDURES FOR LIQUOR OR 3.2% BEER APPLICATIONS
WHEN AN EXISTING OUTLET IS BEING PURCHASED
(Changes in Ownership)

A. REQUIREMENTS:
1. Applications and other relevant documentation must be submitted in
DUPLICATE.
2. General Requirements:
a. Application fee - $750 and $38.50 for FBI checks (plus $100 if a temporary permit is requested and, if applicable, a cabaret application fee)
b. State application
c. Individual history record (for each person)
d. Financial questionnaire
e. Fingerprinting (Required on individuals and all persons having a 10% or greater interest in the applicant; all officers and directors of a corporation; and all managers of the business)
f. Criminal history background checks for non-local applicants: a fingerprint card and a letter of clearance and criminal history record from the local constabulary
g. Purchase agreement (or other documentation supporting the transfer of ownership of the license)
h. A copy of the lease or deed or other possession document
i. An 8 l/2” x 11” detailed diagram of the licensed premises with the dimensions and perimeter highlighted
j. Manager registration (if applicable)
k. Acknowledgment of Transfer of License re: Disciplinary Action
l. Affidavit of transfer
m. Certificate of taxes due from the City Treasury Department
 
3. Corporate Requirements:
a. A current stamped copy of the articles of incorporation (or)
b. The originally filed articles of incorporation together with a current certificate of good standing
c. Current corporate minutes
d. An assumed name registration (if a name other than the corporate name is used)
e. List of officers, directors, and stockholders of parent company (one person designated as “principal officer”)
 
4. Partnership Requirements:
a. Partnership agreement (unless husband and wife)
b.Trade name registration
 
5. Limited Liability Company Requirements:
a. A current stamped copy of the articles of organization (or)
b. The originally filed articles of organization together with a current certificate of acknowledgment
c. Operating agreement
d. Trade name affidavit

6. Signed inspection card approvals from the Public Safety, Fire, and Environmental Health Departments are required prior to the issuance of both the State and City Licenses.

B. Procedure
1. If a temporary permit is desired, a written request for such issuance must be submitted that includes the name and telephone number of a contact person.
2. Once the application, accompanying documentation, and fees are filed with the Department of Excise and Licenses, an inspection card will issue.

3. The application will be reviewed within five days after the filing.

4. A check sheet of any further requirements will be completed and a copy returned to the applicant together with the application.

5. The applicant must then fulfill the remaining requirements and return the completed application to the Department of Excise and Licenses.

6. The file will then be reviewed again within five days after the re-filing.

7. All of the principals to the application must be fingerprinted or must provide clearances prior to the issuance of a temporary permit.

8. Once the application is completed and fingerprints provided (with the exception of the closing documentation), a temporary permit will be issued for 120 days.

9. The applicant is required to contact the City Departments indicated on the inspection card to schedule a time for inspections. (Special modifications to existing business premises may be required by the Building, Fire, and/or Health Departments.)

10. Upon approval of the application by the Department of Excise and Licenses, the applicant will carry the approved application and accompanying documents to the State Liquor Enforcement Division, 1881 Pierce Street, Lakewood, Colorado, for final approval and to purchase the State license. (At this time the State will collect its application fee as well.)

11. After the State’s approval, the state liquor license is sent back to the Department of Excise and Licenses. Once received, the applicant will be notified by telephone that the licenses are ready for issuance and what the City fees are. The City license fees must be paid at the time in order for both licenses to issue.

12. Before the licenses will be issued the applicant must submit the approved inspection card.

13. The Internal Revenue Department requires that a Federal Alcoholic Tax Stamp be purchased by each licensee. For information about obtaining the stamp, call the Alcohol, Tobacco, and Firearms Bureau at (303) 844-7540 or (303) 844-7570.
