Flea markets are generally governed by the provisions of the Denver Revised Municipal Code regarding Second Hand Goods, Section 41.5 et. seq. Persons are exempt from licensing as a second hand dealer if the property they are proposing to sell was not originally purchased for resale and so long as such person does not sell or trade secondhand property more than three weekend periods in any one calendar year. Thus, a person may have up to three garage sales in a year on weekends and not be subject to licensing. Similarly, individuals may sell items at a flea market up to three times a year. Once they exceed the three time limit, they must obtain the proper license if they continue to sell at a flea market.
